These Terms of Use ("Terms") govern your access to and use of the FormOne platform, including the web application, mobile application, and timesheet signing pages (the "Service") operated by Advanced Medical ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

The Service is for use by authorized agency administrators, attendants/PSWs, and clients in connection with workers' compensation attendant care. You must provide accurate registration information, keep your credentials confidential, enable multi-factor authentication where required, and are responsible for all activity under your account. Notify us immediately of any unauthorized use.

2. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with applicable law. You must not: access data you are not authorized to view; submit false, inaccurate, or fraudulent timesheet or care information; attempt to circumvent security, access controls, or audit logging; interfere with or disrupt the Service; reverse engineer or copy the Service; or use the Service to infringe the rights of others.

3. Personal Health Information

The Service processes personal information and personal health information. Your handling of such information through the Service is governed by our Privacy Statement and applicable privacy law (PHIPA and PIPEDA). You agree to access and use such information only as authorized and only as necessary to perform your role.

4. Accuracy of Submissions

Timesheets, care records, and approvals submitted through the Service may be relied upon for WSIB reporting and payment. You are responsible for the accuracy and completeness of the information you submit and confirm that submissions reflect services actually provided.

5. Service Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. The mobile application may operate offline and synchronize when connectivity is restored; you are responsible for ensuring submissions are successfully synchronized.

6. Intellectual Property

The Service and its software, design, and content are owned by Advanced Medical or its licensors and are protected by law. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted.

7. Suspension and Termination

We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or if your authorization to use the Service ends. You may request account deletion as described on our Account Deletion page; note that certain records must be retained for the periods set out in our Privacy Statement.

8. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, or for loss of data, arising from your use of the Service, except as required by applicable law. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting a notice in the application and updating the effective date above. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
